Commercial Waiver Agreement

JYSK Linen 'n Furniture Inc. ("JYSK") is pleased to provide the following warranty (the "Limited Warranty") on home furnishings purchased at JYSK stores ("Products") for commercial use. PLEASE READ THIS COMMERCIAL WAIVER AGREEMENT CAREFULLY BEFORE USING PRODUCTS FOR COMMERCIAL PURPOSES. Your use of products for commercial purposes constitutes your acknowledgement that you have read this Commercial Waiver Agreement and that you agree to follow and be bound by it. JYSK reserves the right to modify or change this Commercial Waiver Agreement at any time without prior notice to you.
1.	LIMITED WARRANTY AND EXCLUSIONS
	JYSK warrants Products against defects in materials and workmanship during the warranty period set out below. The Limited Warranty does not apply to (i) normal wear and tear, (ii) damage caused by accident, impacts, abuse or improper assembly, (iii) damage caused by use of a Product for other than its intended purpose or in an environment for which it was not intended, (iv) damage caused by improper cleaning or use of wrong cleaning products, (v) damage caused by alteration or modification of any Product, or (vi) acts of God. JYSK is not responsible for incidental or consequential damages. The Limited Warranty is granted only to the original purchaser of the Product, and may not be transferred or assigned.
2.	WARRANTY PERIOD
	Please note that not all of our products are manufactured for commercial use. If the products are used for business, the warranty period is limited. When the product is received, the purchaser agrees to inspect the received goods and verify that they are in the expected condition upon receipt of the product. Once product is received in the expected condition, the warranty period ends. Please note mattresses, pillows and bedding cannot be returned once opened and in use in a commercial setting.
3.	MAKING A CLAIM
	If you believe that you are entitled to make a claim under the Limited Warranty, you must, at your cost, deliver the Product to a JYSK store location, together with the original receipt for purchase of the Product.
4.	JYSK OBLIGATIONS
	Upon receipt of a Product for which a warranty claim has been made within the warranty period together with the original receipt for purchase of the Product, JYSK will examine the Product and decide if it is covered under the Limited Warranty. If JYSK determines that the Product is covered, JYSK will, in its discretion, either (i) repair the defective Product, or (ii) replace it with the same Product or, if the defective Product is discontinued or out of stock, a comparable Product. JYSK will decide, in its discretion, whether another Product is comparable to a defective Product. If JYSK determines that a Product is not covered, JYSK will advise you of the reasons for its determination.
5.	APPLICATION OF CONSUMER PROTECTION LEGISLATION
	This Limited Warranty sets out the only warranty, and JYSK's only obligations, with respect to Products, and to the full extent permitted by law all other representations, warranties and conditions are disclaimed by JYSK and waived by you. Notwithstanding the preceding sentence, if you are entitled to the benefit of any representations, warranties or conditions under provincial law that cannot be waived by you as aforesaid, this Limited Warranty does not in any way affect those rights given to you by law. Residents of Quebec are governed by that province's consumer protection legislation. Les résidents du Québec sont régis par la législation sur la protection du consommateur de cette province.
